Talaq

Postby Boycs » Tue Aug 22, 2017 6:04 pm

Triple Talaq, the 'instant divorce' has been banned by India Courts (http://www.bbc.co.uk/news/world-asia-india-41008802)

I wonder if this is hideously distorted by the BBC and English media. Is this really a practice followed by even a small minority in India?

And also there was this news article, also set in India, that someone can explain for me:

I still not click your link but as far as I know, its only in Muslim Country that is how they take Divorce not the Hindu country accepted their term of divorces in Indian culture.

Probably Indian Muslim community should only effected with the new law.

Though BBC are known to distort facts, in this case, no distortion is possible. The truth is far more hideous. Muslims males in India were practicing instant divorce under the pretext that it was allowed according to their holy book. Now it turns out that the Muslim priests (maulvis) were misinterpreting things and the Holy Koran does not mention this triple talaq anywhere. All these years, the Indian ruling political parties decided to pander to the muslim males because it was believed that appeasing muslims (read muslim males) was essential to win elections in India. In fact, supreme court of India passed one order in favour of a muslim lady (that she should be paid maintenance by her husband who had divorced her) in 1987. The then Indian government, instead of complying with the Supreme Court order, went to the extent of amending rules to ensure that muslim women were denied any such maintenance. That was the kind of muslim appeasement that the Indian governments over the years have indulged in. So, such governments were unlikely to take any proactive actions to better the lots of muslim women.

The supreme court this time was emboldened to give this landmark jugdement because the present Indian government does not believe in muslim appeasement and this government was in support of abolishing triple talaq. So muslim women in India for the first time can hope to lead a life of dignity which they were denied till now. Since it was so easy to divorce them, they did not enjoy any rights to property either and only muslim males held properties. So one can imagine the poor state of affairs for muslim women in India.

Curiously enough, this triple talaq practice is not there in muslim countries, viz Pakistan, Bangladesh etc. So the Muslim religious heads in India were taking muslims in India for a ride all these days telling them that it was mentioned in the holy book. All this was just a cruel attempt to subjugate muslim women and deny them any rights to dignified life, property etc.

even worse is this evil practice of halala.

an old man (60+) had a dream that he said talaq 3 times in his sleep. the moulvi said it's legit and he should divorce his wife of 35+ years. the solution offered is that if that old lady sleep with stranger through halala practice she can remarry and be with her husband

Nikah halala practice is obnoxious and far worse than triple talaq as GS mentioned. There is a sentiment in India for uniform civil code which will govern all religions. But a uniform civil code is opposed by Muslims. They want to be governed by Islamic Law related to marriage Shariah.

The only time I hear about Nikah Halala and Tripple Talaq is in relation to India.

I wonder if its a India special thing or also practised elsewhere too. Both horrendous and both practice should be banned.
